Backhaus Knew About Air-Cushion Technology – Yet Left Timmy to Suffer Needlessly

Today, Environment Minister Till Backhaus suddenly approved a rescue attempt using air cushions. This is the very technology that has been successfully deployed for decades in international whale stranding operations. Backhaus and his ministry had every reason to know about it. Instead, they allowed Timmy to lie motionless in shallow water for 16 days, subjecting the whale to prolonged, agonising suffering.

The technique is well-established. Since 1984, Whale Rescue New Zealand has used inflatable rescue pontoons during mass strandings of pilot whales and humpback whales. The pontoons are positioned under or beside the animal, inflated, and used to stabilise it while it is gently guided into deeper water. The method has saved hundreds of whales and is regarded as an international standard in stranding response. Similar inflatable lift bags and pontoon systems are routinely employed in Australia and the United States for humpback whales trapped in shallow areas.

Backhaus had 16 full days to evaluate and implement this proven technology. Instead, he repeatedly claimed that further rescue efforts were not feasible. The criminal complaint filed on 8 April 2026 by authors Marita Vollborn and Vlad Georgescu accuses him of animal cruelty by omission. The complainants argue that the prolonged passive acceptance of the whale’s obvious and severe suffering violates § 17 Abs. 1 Nr. 1 Buchst. b) TierSchG. Tomorrow, Thursday, they will submit additional material to the Public Prosecutor’s Office in Rostock to strengthen the case.

The sudden U-turn with the air-cushion plan appears to be a desperate damage-control measure. After 16 days of severe suffering, a rescue is now suddenly declared possible. Timmy is already so weakened that the chances of success have plummeted. The delay has caused irreversible harm — exactly what the criminal complaint identifies as a criminal omission.

The case reveals systemic failure. Rather than deploying internationally established rescue methods, Backhaus and his authorities chose bureaucratic caution and institutional convenience. The German Oceanographic Museum in Stralsund, which is closely tied to the state, has already expressed interest in the carcass. The decision to let Timmy suffer ensures that the publicly funded museum will receive a valuable skeleton free of charge.

As the highest authority, Backhaus bears full responsibility. He set the official line. He ignored international standards. He provoked the criminal complaint against himself. The Public Prosecutor’s Office in Rostock must now determine whether this constitutes not only a violation of animal protection law but also a breach of the principles of lawful governance.

The new air-cushion rescue attempt comes 16 days too late. It comes after Timmy has been severely weakened. It comes after the authorities spent 16 days ruling out every possibility of humane intervention. It comes only after the criminal complaint was filed and the prosecutor’s office began its review.

This scandal is not a tragic fate. It is the result of a deliberate political decision. The law forbids exactly what happened here. If the rule of law functions, this decision must have consequences.
